Please read these Terms of Service ("Terms") carefully before using our services. By contacting us, submitting an application, or working with us in any capacity, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Our Services

Hawthorne Legacy Group is owned by a licensed life and health insurance broker. We help individuals, families, and businesses evaluate, apply for, and obtain life insurance, health insurance, supplemental coverage, and related insurance products offered by third-party insurance carriers ("Carriers").

We act as an independent agent or broker. We do not underwrite, issue, or administer insurance policies. All coverage, premiums, claims, and policy terms are governed solely by the applicable Carrier and the insurance contract between you and that Carrier.


2. Our Role & Limitations

2.1 Agency relationship

We represent you in the marketplace — not any single Carrier. Our role is to help you identify suitable coverage options and facilitate the application process. We do not guarantee acceptance, approval, or issuance of any policy by any Carrier.

2.2 Carrier responsibility

All premium billing, payment processing, policy administration, claims handling, and coverage decisions are the sole responsibility of the applicable Carrier. Hawthorne Legacy Group is not a party to your insurance contract and has no authority to bind, alter, or cancel coverage on behalf of any Carrier.

2.3 No guarantees

We do not guarantee that any product we present will meet your needs, that premiums will remain unchanged, or that a Carrier will approve your application. Final eligibility and underwriting decisions rest entirely with the Carrier.


3. Your Responsibilities

Provide accurate, complete, and truthful information on all applications and forms.

Review all policy documents, summaries of benefits, and Carrier communications carefully before accepting coverage.

Notify us promptly of changes in your circumstances that may affect your coverage needs or eligibility.

Direct all billing, claims, and policy service matters directly to your Carrier.

Comply with all Carrier requirements, including timely premium payments.

Misrepresentation or omission of material facts on an insurance application may result in denial of coverage, rescission of a policy, or denial of claims by the Carrier.


4. Compensation

Hawthorne Legacy Group is compensated by Carriers in the form of commissions when you enroll in a policy we facilitated. This compensation is paid by the Carrier and does not increase your premium. We may also receive bonuses or incentives from Carriers based on production volume.

You have the right to ask us about our compensation arrangements with any Carrier we recommend.


5. Confidentiality & Privacy

We handle your personal and health information with care and in accordance with applicable law, including HIPAA where relevant. Please review our Privacy Policy for full details on how we collect, use, and protect your information.

We will not sell your personal information to third parties. We may share information with Carriers, MGA/FMO partners, and service providers as necessary to fulfill your coverage requests, subject to confidentiality obligations.


6. Intellectual Property

All content on our website — including text, graphics, logos, and materials — is owned by or licensed to Hawthorne Legacy Group and protected by applicable law. You may not reproduce, distribute, or use our content without written permission.


7. Disclaimers

7.1 Not legal or tax advice

Nothing we provide constitutes legal, tax, or financial advice. We recommend consulting qualified professionals for guidance specific to your situation.

7.2 Website content

Information on our website is for general informational purposes only. We make no warranty as to its accuracy, completeness, or suitability for any particular purpose.

7.3 Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SERVICES AND WEBSITE CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.


8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAWTHORNE LEGACY GROUP'S LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR OUR SERVICES SHALL BE LIMITED TO THE AMOUNT OF ANY AGENCY FEE ACTUALLY PAID DIRECTLY TO US IN CONNECTION WITH THE MATTER GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR ANY CARRIER DECISIONS, COVERAGE GAPS, CLAIMS DENIALS, OR PREMIUM CHANGES.

IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.


9. Indemnification

You agree to indemnify and hold harmless Hawthorne Legacy Group and its officers, employees, and agents from any claims, damages, or costs arising from your misrepresentation on applications, your breach of these Terms, or your violation of any applicable law.


10. Acceptable Use

When using our website or communicating with us, you agree not to:

Provide false or misleading information for the purpose of obtaining coverage;

Attempt to gain unauthorized access to our systems;

Use our site for any unlawful purpose; or

Impersonate our agency or any employee.


11. Dispute Resolution

11.1 Informal resolution

Before pursuing formal action, both parties agree to attempt good-faith resolution through direct communication for thirty (30) days following written notice of any dispute.

11.2 Arbitration

Unresolved disputes shall be settled by binding arbitration under the rules of the American Arbitration Association, conducted in Jefferson County, Alabama. The arbitrator's decision is final and may be entered as a court judgment.

11.3 Carrier disputes

Disputes regarding policy terms, premiums, claims, or coverage decisions must be directed to your Carrier directly and are not subject to arbitration with Hawthorne Legacy Group.


12. Governing Law

These Terms are governed by the laws of the State of Alabama. Subject to the arbitration provision above, both parties consent to jurisdiction in the state and federal courts of Jefferson County, Alabama.


13. General Provisions

Amendments: We may update these Terms at any time by posting revised Terms with a new effective date. Continued use of our services constitutes acceptance.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.

Entire agreement: These Terms and our Privacy Policy constitute the full agreement between you and Hawthorne Legacy Group regarding our services.

Force majeure: Neither party is liable for delays caused by events outside reasonable control.
